Fair Consideration Framework of Singapore

The Singapore Workplace Equity Act will come into effect in 2026 or 2027. The bill will require employers to publish job postings on the MyCareersFuture website and fairly consider all local job seekers' applications before submitting their employment or S-permit applications for foreign employees.

That is to say, if the bill is passed, from the day it officially takes effect, all companies in Singapore that recruit EP/SP employees must strictly comply with this regulation.

This reminds us of the Singapore Fair Consideration Framework. Specifically, let's take a look:


What is a Fair Consideration Framework?

The Fair Consideration Framework (FCF), introduced by the Singapore MOM in 2014, ensures that employers prioritize Singaporeans before hiring foreign employees. The specific measure is that before applying for a new EP, employers must first publish at least 14 days of job advertisements in the job database to attract Singaporean job seekers.


The New Regulations for the FCF?

According to the latest policy of MOM, under the FCF, companies must first publish job advertisements for 14 days and fairly consider all candidates before submitting EP (monthly salary below $ 22500) applications.


Who Can Exempt From the FCF?

If the following conditions are met, exemption can be granted:

1) The company has less than 10 employees;
2) The monthly salary for this position exceeds SGD 25000;
3) This position is filled through internal transfer within the company (your company's existing employees in Singapore are transferred to another branch, subsidiary, or affiliated company in Singapore)


Do Job Advertisements Have to be At Least 14 days?

Yes, before submitting an EP application, a recruitment advertisement needs to be posted first, and it takes at least 14 days to submit the EP application. However, we generally recommend posting for 28 days because the longer the advertisement is posted, the higher the success rate. However, if you are in a hurry to apply for a pass, you don't necessarily have to wait for 28 days, but it will take at least 14 days. It's up to you to handle urgent matters, case by case。


What are the Consequences of Violating the FCF?

If the MOM feels that your EP application violates this framework, such as some employers pre selecting foreigners before posting job advertisements and not reviewing applicants on the job advertisements, while some employers post discriminatory job advertisements, etc., your EP application may be rejected, and in severe cases, you may be prohibited from hiring foreign employees.
